The Albuquerque Police Department (APD) arrested 13-year-old Jonathan Overbay Monday after he allegedly rammed into a 63-year-old bicyclist in a stolen vehicle, authorities said.
The APD charged the teenager with intentionally ramming Scott Habermehl, the bicyclist, on May 29, 2024, according to a City of Albuquerque press release. The incident led to the man’s death.
APD Chief Harold Medina said Tuesday at a press conference that he was alerted on Friday about a potential homicide. The act was initially classified “as a possible traffic fatality” but then more recently a video emerged that led to the allegations.
The police chief further relayed that one of the individuals allegedly involved in the crash was a then-11-year-old police were already familiar with. This 11-year-old in the video is shown carrying a gun, he said. He is now “listed as a runaway,” the chief added. A 15-year-old, William Garcia, was also allegedly involved in the act. “They see the guy in the bike and they make the decision they are going to strike him,” Medina said. The police chief promised that the footage would be released later that day.
“Just bump him, brah,” a voice inside the car appears to say in the footage. “Should I bump him?” a second voice asks. “Yeah, you just bump him. Go like 15, 20,” the first voice appears to direct.
“Seeing the video was extremely disturbing and hearing about it unfortunately wasn’t surprising because it’s been happening more and more and the juveniles have been getting younger and younger,” Republican State Rep. Nicole Chavez told KRQE.
“I am horrified by the video footage of this brazen, heartless killing involving three juveniles—ages 11, 13, and 15—who targeted an innocent cyclist. This case is an appalling and heartbreaking reminder of the serious juvenile crime crisis we face in New Mexico––and our lack of tools to properly address it,” Democratic New Mexico Gov. Michelle Lujan Grisham said.
The APD is still searching for 15 year-old suspect William Garcia. “Garcia is wanted in connection to a homicide that involved an Albuquerque cyclist on his morning commute to work. The teen was with an 11 and 13 year old during the incident that was recorded while the group appeared to intentionally strike the cyclist,” APD said in a press release.
In addition to the allegation of murder, Overbay faces a litany of other charges including leaving the scene of an accident, authorities said. Garcia faces the same charges. The 11-year-old is not old enough to face a charge of murder.
