An FBI agent previously acquitted of attempted murder after shooting a man on a train has been arrested on sexual assault charges.

Eduardo Valdivia was charged with sexually assaulting two women by police in Montgomery County, Maryland. According to court records viewed by the Associated Press, Valdivia was hit with felony and misdemeanor charges, including two counts of second-degree rape. The offenses occurred in May 2024 and September 2024.

“The FBI takes allegations of criminal violations and misconduct very seriously,” an FBI spokesperson said in a statement. “Because this is an ongoing investigation, the FBI cannot comment further.”

Defense attorney Robert Bonsib represented Valdivia in the 2020 train shooting case and confirmed he had been arrested.

“We don’t accept at first blush any of the allegations until all of the evidence is in,” he told the outlet.

Police detectives told the outlet that they are planning a press conference on Tuesday to urge other possible victims to speak out. Valdivia will appear in court on the same day.

The FBI agent earned headlines in 2020 when a heated confrontation with a passenger escalated to him shooting them from two or three feet away. The man was severely wounded, requiring extensive surgery, but survived. The court ultimately sided with Valdivia’s argument of self-defense and acquitted him.
